OCHENTA AÑOS DE PRISIÓN POR UN 80% DE CONVICCIÓN MORAL

Pienso que, dada la irreversibilidad de la sentencia, el agotamiento del sistema jurídico mediante el que hacer publicidad de esta injusticia y la necesidad de que ella se conozca, es interesante que os haga un resumen de los sucesos que han conducido a la encerrona con la que el Estado ha perseguido y, por ahora, conseguido que me vea condenado a prisión de por vida.
El día 6 de febrero de 2006, a las 21 horas, los GRAPO realizaron una acción de recuperación de fondos en la persona de dos empresarios zaragozanos de ETT´s, que se saldó con la empresaria muerta y su esposo herido.
Ese día y a esa hora yo me encontraba en mi casa de Reus (Tarragona) junto con mi compañera Carmen Cayetano, y otra camarada, Arantza Díaz; los tres componíamos el “Comité del Interior” del PCE(r) en la clandestinidad, siendo yo su responsable. Hacíamos tareas de propaganda (redacción, edición y distribución del periódico “Resistencia”) y organización entre trabajadores de todo el territorio del Estado español y de centralización de las diferentes organizaciones del Partido. Por estos “delitos” ya fuimos condenados a 11 años de prisión.
Llamo la atención sobre la naturaleza de nuestras actividades, que nos obligaban a desplazarnos frecuentemente para ver militantes y simpatizantes del Partido que, en la mayoría de los casos, estaban fichados por la policía, con lo que teníamos que extremar las medidas de vigilancia, protección y compartimentación para evitar caidas y para que, caso de producirse, no afectaran a otros organismos del Partido, en especial a su dirección, con la que yo era el encargado de mantener contacto.
Volviendo a la acción de los GRAPO en Zaragoza, a los 3 ó 4 días, en torno al 10 de febrero de 2006, salió en todos los medios burgueses mi foto y la del compañero Israel Torralba como sus autores, caso que se fue repitiendo con mi persona cada vez que los GRAPO realizaban una acción hasta la fecha de mi detención en Reus, en junio de ese mismo año, por efectivos de la guardia civil.
En un principio, las presiones en la Dirección General fueron destinadas a que confesara mi participación en los hechos de Zaragoza; en el caso de mi compañera, fue torturada para que me incriminara. Nuestra lógica negativa fue firme y rotunda desde principio a fin. Ante esta actitud y una vez comprobaron la lógica incompatibilidad del trabajo partidista que veníamos haciendo con haber podido participar en la preparación y ejecución de una acción tan compleja como la de Zaragoza, llegó un momento, relativamente temprano, en que los guardias civiles dejaron de lado este asunto, llegando a decirme que, efectivamente, yo no podía haber estado allí. De hecho, a partir de esos momentos, lo de Zaragoza sólo aparece, tanto en el atestado de la guardia civil como, luego, en el interrogatorio del juez, con la simple pregunta de “¿Ha participado usted en... de Zaragoza?” y el no de mi respuesta, sin más preguntas, ni averiguaciones, ni auto de procesamiento y prisión, ni tan siquiera una vez detenidos los militantes de los GRAPO que, efectivamente, realizaron la acción, Xurxo García Vidal e Israel Clemente. O sea, ni Torralba ni quien escribe.
En esas fechas, fui trasladado varias veces desde la prisión de Puerto I, donde me hallo, a Madrid, alguna vez en conducción especial, al objeto de someterme a ruedas de reconocimiento, a las que consentí voluntariamente porque, ¡incauto de mí!, sabía que no había participado en ninguna acción armada de los GRAPO y, por tanto, ningún testigo podría reconocerme. De la media docena de ruedas en las que participé, nadie me reconoció, como es lógico... Hasta la última, donde una supuesta testigo dijo reconocerme “en un 80%”. A partir de aquí, y encontrado el soporte legal con el que “construir la imputación” -según término acuñado por un ministro de justicia socialista-, vino el auto de procesamiento por la acción de Zaragoza (noviembre de 2007), el auto de prisión y, en mayo de 2009, el juicio. A destacar que, entre 2007 y 2009, no se me hizo ninguna diligencia más sobre estos hechos, ningún interrogatorio ni indagatoria, y ello a pesar de que yo presenté una coartada de mi estancia en Reus, de que hubo un cambio de Juez Instructor en la Audiencia Nacional y de que los compañeros de los GRAPO declararon desde su detención y en muy diversas ocasiones ante el juez, que yo no había participado (de hecho, en sus interrogatorios, la guardia civil ni les preguntó por mí). Es decir, que ya entre policías y jueces tenían muy claro que yo debía ser condenado por lo de Zaragoza y, “encontrada” la testigo providencial, sobraba cualquier investigación que buscara la verdad.
A pesar de saberme condenado de antemano, decidimos -conjuntamente con mis abogados- hacer un juicio “con todas las de la ley”, dar la batalla jurídica ante la total endeblez y más que segura “preparación” de la prueba testifical en mi contra; en el peor de los casos, siempre podríamos poner en evidencia el sometimiento del supuesto “Poder Judicial”, y en especial de ese tribunal de excepción que es la Audiencia Nacional, a los designios políticos del Ejecutivo; al mismo tiempo, quedaba abierta la puerta a las instancias internacionales para denunciar y dejar patentes los disparates jurídicos que asume el sistema jurídico español y las vulneraciones de cualquier principio judicial (presunción de inocencia, peso de la prueba, etc.) que supondría una sentencia condenatoria
En el juicio se oyó y quedó claro todo lo arriba expuesto:
Repetí mi negativa a haber participado en los hechos. Se explicó la imposibilidad orgánica y de seguridad que suponía el estar yo, al mismo tiempo, haciendo trabajo en un Comité del Partido y participando en la preparación y ejecución de la acción de Zaragoza. Se presentaron testigos que respaldaban mi estancia en Reus el día de autos. Los compañeros de los GRAPO explicaron la acción minuciosamente, dejando muy claro mi no presencia en ella. En el interrogatorio a los testigos, los principales, es decir aquellos que vieron de cerca y durante tiempo “A un señor de 50 años y canoso”, no me reconocieron. No hubo ninguna prueba material (huellas, grabaciones, armas, etc.) que avalara mi presencia en Zaragoza.
Por contra, el tribunal rechazó la presencia en el juicio de guardias civiles (excepto peritos en balística) ¡cuando eran ellos los que me detuvieron, interrogaron e hicieron lo mismo con los militantes de los GRAPO!.
La fiscalía sólo pudo presentar como “prueba” la sentencia del Supremo que dice que “El PCE(r) y los GRAPO son los mismo” y la famosa y única“testigo protegida” que se cruzó fugazmente conmigo supuestamente, claro, y que al dar mi descripción, ésta coincidía justamente con la foto policial que salió en toda la prensa esos días.
En noviembre de 2009 llegó la sentencia condenatoria de ¡¡¡80 años!!!. ¿En qué ha empleado esos seis meses el Tribunal? Misterio, ya que basta leer la sentencia para darse cuenta de que se limita a transcribir y dar por bueno el informe del fiscal. Resulta llamativo que, para sostener como bueno el hecho de que la “testigo protegida” solo me reconociera en un 80%, el Tribunal diga que confía en su “convicción moral” de que era yo dicha persona. Es decir, que en realidad mi condena descansa no en la “convicción moral” del juez (caso que ya se ha dado en otras ocasiones de condenas sin pruebas), sino en la de ¡¡un testigo!! -protegida y con un 80% de convicción-.
Por lo demás, en la sentencia se elude todo aquello que pudiera beneficiarme, resultando llamativo que mi abogado y sus intervenciones “desaparecen” del texto una vez que se le cita al principio del texto para dejar constancia de su presencia, no de sus intervenciones.
Hay una segunda parte tragicómica de esta farsa judicial. Tras la condena, quedaba abierta la posibilidad de recursos a otras instancias (Supremo, Constitucional, Europeo) para, desde nuestra denuncia, dejar en evidencia la venalidad y falta de garantías del sistema judicial español. Pues bien, ¿cuál no sería mi sorpresa y la de mis abogados cuando, al ir a presentar el correspondiente recurso al Tribunal Supremo (primera instancia en los recursos), no pudo hacerse ¡porque se había “pasado el plazo”!, debido a “malentendidos” burocráticos -aún no aclarados- en la cadena Tribunal-Procurador-Abogados?
En fin, heme aquí definitivamente condenado a cadena perpetua (saldría de la cárcel en 2046 con 104 años de edad -tengo 58 años-), sin ley ni derecho que me ampare y por unos hechos que no realicé.
Es verdad que yo era consciente de que el régimen no iba a dejar impune el mantenerme “erre que erre” (esa “r” tan querida y presente para mí) con mis ideas revolucionarias a lo largo de 40 años de militancia comunista; al fin y al cabo es el “trato” que les ha venido dando el Estado a todos mis camaradas que me han precedido en prisión. Tampoco el Estado me iba a perdonar que, tras 20 años de estar encarcelado de 1978 a 1998, me reincorporara al trabajo clandestino de mi Partido.
Sin embargo, debo confesar que la saña y afán de venganza de este régimen y los gobiernos que lo gestionan no deja de sorprenderme, viendo en mi propio pellejo cómo usan todas las artimañas y recursos de su sistema jurídico para hacer legal una represión desaforada contra un puñado de comunistas; es lo que hemos visto recientemente con la condena por “omisión” (¿?) a nuestro Secretario General, Manuel Pérez Martínez, y, en lo referente a mi caso, al endosarme una acción, una militancia y una muerte que saben positivamente que no hice. ¿Franco puede estar orgulloso de sus herederos!
Es indudable que la cadena perpetua, y encima tan a todas luces injusta, no deja de ser un golpe que se siente, tanto en lo personal como por mi familia, que se ve también condenada -y en mi caso sin el “colchón” ideológico que les ayude a entender y asumir la nueva situación- a renunciar a mi presencia a su lado en el futuro.
Pero, al mismo tiempo, la brutal sentencia despeja el panorama de mi futuro político personal, al convertirme irremediablemente en un proletario “que no tiene nada que perder salvo sus cadenas”, ligando, así, mi suerte a la de los desposeídos, los explotados, los represaliados, los “sin salida”, los rebeldes, los radicales de raíz...
Ahora soy más consciente que nunca de que, si tengo alguna clase de futuro, éste está, no en manos de mis enemigos de clase ni de mis carceleros, sino en las del Movimiento Obrero Revolucionario, en quien tengo puesta toda mi confianza ya que es el único capaz de torcer los negros designios de los fascistas.
Lo único que me han dejado, mi dignidad de revolucionario impenitente, mis ideas y experiencia comunistas y mi espíritu resistente siguen a disposición de dicho movimiento con la confianza de que, a pesar de lo desorientado, desorganizado y postrado en que hoy se encuentra, no tardará mucho en recuperarse, como ha dicho repetidas veces el PCE(r), aunque la situación sea muy difícil, “Las condiciones vendrán en nuestro auxilio”, y estas cada vez son más favorables para dicho resurgimiento.
La crisis económica deja a los obreros “sin nada que perder”, la crisis política del Estado deja sin espacio a las ilusiones reformistas y la represión creciente -de la que la persecución brutal a nuestro Partido no es más que “avance”- deja despejado el camino para la lucha radical contra ese régimen.
Yo no tengo nada de lo que arrepentirme; si acaso, y vista mi condena a perpetuidad por hacer trabajo político “no violento”, sólo puedo arrepentirme de no haber estado de verdad echando una mano a los compañeros de los GRAPO que hicieron la acción de Zaragoza.
Pienso que, en la misma medida, hoy cualquier trabajador, cualquier resistente, sólo se debe arrepentir de no defender con uñas y dientes su puesto de trabajo y el pan de sus hijos, de no dar una patada a las mafias sindicales y a los vividores de la política, de no usar su unidad, organización y fuerza de clase para luchar decididamente contra este podrido régimen de explotación, opresión y agresión.
En este terreno de la organización y lucha revolucionarias nos encontraremos y, estoy seguro, los presos políticos recobraremos la libertad.
Febrero de 2010, cárcel de Puerto I (Cádiz)

HEMEROTECA:
La Audiencia Nacional ha condenado a penas de entre 80 y 82 años de cárcel a los militantes de los GRAPO Israel Clemente López (a 82 años) y Jorge García Vidal (a 81) y al ¡militante del PCE(r)! Juan García Martín (a 80), por la muerte en 2006 en Zaragoza de Isabel Herrero, empresaria propietaria de ETT´s y mujer del empresario Francisco Colell, y herir gravemente a éste cuando ambos se resistieron a ser secuestrados en Zaragoza.
La sentencia, hecha pública hoy 1 de diciembre por la Sección Segunda de la Sala de lo Penal, justifica la condena de Clemente y García Vidal recordando que durante el juicio, que se celebró los días 7 y 8 de mayo de 2009, admitieron los hechos con "especial frialdad y desprecio a todo sentimiento humano". "Si hubiera tenido 15 balas, habría disparado las 15", llegó a asegurar Clemente. "Arrepentido estará tu puta madre, gran hijo de puta", le dijo García Vidal al fiscal Miguel Ángel Carballo.
En relación con el tercer procesado y penado, que aseguró en reiteradas ocasiones que nada tenía que ver con los GRAPO, ya que él “era militante clandestino del PCE(r) y que el PCE(r) no desarrolla la lucha armada”, y que además, en el momento de los hechos vivía en Reus (Tarragona), y no en Zaragoza, “cosa que la guardia civil sabe”, el tribunal considera “acreditada su participación a partir del testimonio de varios testigos que vieron a un hombre de unos 50 años y pelo canoso en la puerta de salida del garaje. Una de ellas le identificó sin género de dudas ((mentira, a un 80%)) y otro aseguró ((que alguien parecido)) hablaba por un teléfono móvil, presumiblemente con Israel Clemente, a quien Colell vio portando un "pinganillo rígido" o auricular”.
Según el capítulo de hechos probados de la sentencia, a las 21.00 horas del 6 de febrero de 2006: “Tres (2, según el propio Colell) personas se presentaron en la vivienda de la pareja, situada en el número 11 de la calle Cervantes de Zaragoza. Clemente y García Vidal entraron en el garaje cuando ambos pretendían recoger su vehículo y García les esperó a la entrada para asegurarse de que ningún vecino les veía” (esto es imposible presentarlo como hecho probado, porque no lo es).
“Allí, los dos se identificaron diciendo: "Somos miembros de los GRAPO, esto es un secuestro (dudo muchísimo que emplearan esa palabra), no hagan nada y no les pasará nada, conocemos toda su vida, Francisco Colell, y también la de su hermano, sólo venimos a por su dinero, entrégueme el móvil".
Tras comprobar que el empresario no iba armado, les ordenaron que entraran en su coche aunque en ese momento accedió al garaje otro vehículo”.“Esta circunstancia aumentó el nerviosismo de Herrero, lo que, según la sentencia, le hizo sufrir un desvanecimiento. En ese momento, Colell aprovechó para entrar en su vehículo, ponerlo en marcha e intentar salir del lugar arrollando a los miembros de los GRAPO. Para evitar la huida, Clemente disparó cinco veces contra el parabrisas del vehículo, causando graves heridas al empresario. Su mujer intentó escapar aunque García Vidal le dirigió dos disparos (...)”.
A continuación, según recoge el capítulo de hechos probados de la resolución judicial, “arrojaron el bolso de la fallecida en la calle Cervantes y se dieron a la fuga.”
Todo el resto del escrito es ciencia ficción. En todo el juicio, ambos militantes de los GRAPO se reivindicaron una y otra vez como tales y reconocieron la acción, y dieron datos de cómo la desarrollaron. Siempre dijeron -y sólo eso son hechos realmente comprobados-, que la acción armada la desarrolló un comando de dos personas.
Toda la información policial y periodística posterior habló de 2 personas. Sólo tras la más que segura concordia policial esas personas se elevaron a 3.“Un hombre de unos 50 años y pelo canoso se encontraba en la puerta de salida del garaje. Una de ellas le identificó sin género de dudas”. ¿De verdad?. ¿Con esa información general -hombre, 50 años, pelo cano-?. ¿Acaso no es verdad que en todos los periódicos aragoneses del 8, 9, 10... de febrero de 2006 se recoge que un testigo decía sólo y literalmente que el supuesto tercer integrante era “de más edad” que los jóvenes -una vez mostradas a los testigos las fotos de Clemente y Vidal, de 34 y 36 años de edad-? “Y otro aseguró que hablaba por un teléfono móvil”, “presumiblemente con Israel Clemente, a quien Colell vio portando un "pinganillo rígido" o auricular”. ¿Presumiblemente? ¿Qué tipo de prueba de hecho demostrado es una de la cual se dice que sólo es presumible?.
En todo el juicio, Juan García Martín, militante del partido político PCE(r) -ilegalizado en 2003-, que no desarrolla la lucha armada, dejó claro y meridianamente demostrado que él era un militante político, no armado, y que por lo tanto jamás pudiera haber sido él el supuesto tercer hombre del comando, si es que se supone que fueron tres, y no dos como todo apunta, claro. Y que la Guardia Civil sabía que García Martín residía en Reus, por la simple cuestión de que fue detenido a los pocos meses, y hubieran tenido que detectar sus supuestas frecuentes idas y venidas a Zaragoza.
Por no hablar de que la muerte de la empresaria zaragozana ya fue “colgada” en varias ocasiones a otras personas. La primera, “sin ningún género de dudas” el 26 de febrero de 2006 -20 días después de su muerte- al clandestino, pero no militante de los GRAPO Israel Torralba Blanco: “Detenido por la Ertzaintza en Bilbao el GRAPO que asesinó a la empresaria en Zaragoza”. (Portadas de decenas de diarios de toda España el 27 de febrero 2006). Luego Torralba desapareció a la chita callando de las portadas. La propia Ertzantza dejó en vergüenza su propia declaración al tener que reconocer que no era posible su participación en la acción mortal, pues no era militante de los GRAPO desde hace 4 años atrás. La segunda, en 2007 tras la detención de Lucio García Blanco, de 57 años, también militante clandestino del PCE(r) -que tampoco de los GRAPO-, al que algún medio apuntó como al cincuentañero canoso. Se volvió a repetir la chita callando. Así es la prensa que se dice objetiva.
Tras detener a Juan García Martín el 9 de junio de 2006 en Reus, junto a otras dos militantes del PCE(r), la gallega Carmen Caetano y la vasca Arantza Díaz -que tiene denunciadas ante el Juzgado las brutales torturas que sufrió-, desarrollando labores políticas, entre ellas las clandestinas -que jamás armadas, pues así lo dice la historia de 35 años de esa organización, cuyo programa y estatutos están al alcance de cualquiera en internet-, la cuadratura se cerró: “Ya tenemos a un clandestino” -¡qué más da que sea del PCE(r), que no practica la lucha armada!-. “De más edad que los otros dos, y pelo cano” -aunque tenía 55 años el día de autos y en las declaraciones ya salió que en su vida clandestina lo podía llevar... de varios colores, pues es casi calvo como se puede apreciar en las imágenes que todos podemos rescatar de internet-. “¡Ya tenemos todas las pruebas!” parece que han dicho, atado y sentenciado. Ochenta años de condena, que se sumarán a los 20 que ya cumplió tras su anterior detención en 1978.
Leía ayer 30 de noviembre en GARA un artículo de Jon Odriozola sobre Manuel Pérez Martínez "Camarada Arenas", Secretario General del PCE(r) y único dirigente comunista preso en dos Estados desde los tiempos de Dimitrov, 17 años en la cárcel y condenado recientemente por una aberración jurídica que han definido como "omisión del delito". ¿Sería aventurado decir que -si aplicasen tabla rasa jurídica- cientos de dirigentes del PSOE y del PP y cabezas aún mucho más altas se debieran estar pudriendo en la cárcel por la misma omisión de multiples delitos?.
