OCUPACION DE LA SEDA DEL INSTITUNO MADRILEÑO DEL MENOR POR EL CIERRE DEL PICÓN

En la mañana de hoy alrededor de 30 personas han irrumpido en la sede del Instituto Madrileño del Menor y la Familia para exigir la clausura inmediata del centro de menores Picón.
Varias personas han subido a los balcones del edificio desplegando una pancarta, otro grupo de solidari@s se ha mantenido en el hall gritando en solidaridad con l@s chavales y varias personas más han permanecido en el exterior con una segunda pancarta.
Además, se ha hecho público el siguiente cominicado:
CENTRO DE MENORES PICÓN DE JARAMA.
Realizamos esta acción para solidarizarnos con los adolescentes encerrados en el centro de menores Picón de Jarama. Hace ya varias semanas que se hizo pública la situación de malos tratos que se vive en ese centro, gestionado por la Fundación O´Belén, y sin embargo los adolescentes allí internados no han sido liberados y los malos tratos continúan completamente impunes o han sido paliados temporalmente.
Hace más de 5 meses que Hamid el Amrani murió ahorcado cuando estaba aislado en su celda de Picón de Jarama. Han pasado otros 2 meses desde que el Defensor del Pueblo presentase un informe señalando que existen al menos 12 procesos judiciales abiertos respecto al mismo centro y señalando negligencias de todo tipo.
Sin embargo “Picón” continúa funcionando y no sólo no se ha derivado responsabilidad alguna, sino que siguen produciéndose violaciones de los derechos humanos y malos tratos en su interior. Temporalmente se han adoptado algunas medidas paliativas; los menores afirman que se han reducido los periodos de aislamiento, los insultos y las agresiones, pero la entidad gestora se mantiene, el equipo “educativo” es prácticamente el mismo y la situación es de completa impunidad. Los responsables de la Comunidad de Madrid, comenzando por la Consejera de Familia y Asuntos Sociales en lugar de tomar medidas contundentes han negado que existiesen denuncias, quejas, y los propios malos tratos, faltando a la verdad públicamente, criminalizando y restando credibilidad a los chicos y chicas a quienes supuestamente “protegen”.
La principal circunstancia que denunciamos es que Picón de Jarama se constituye de hecho como un centro de detención para menores desamparados que no han tenido la posibilidad de defenderse en juicio alguno. Sometidos a distintos regimenes (desde aquellos que permanecen constantemente en el interior del recinto hasta aquellos a quienes se permite acudir a centros educativos y laborales o salir por periodos determinados de tiempo), estos menores son privados de libertad en base a criterios subjetivos de funcionarios o incluso trabajadores de entidades privadas. Se está violando lo dispuesto en los artículos 763 de la Ley 1/2000 de Enjuiciamiento Civil, 271.1 del Código civil y 6 del Decreto 246/2005 que señalan claramente que ninguna persona puede ser sometida a internamiento psiquiátrico sin ser escuchada previamente y sin la previa autorización judicial, independientemente de su edad o capacidad intelectual.
Como agravante, la reclusión no se produce bajo gestión pública sino en el interior de una institución privada tras la cual se encuentran intereses económicos que hasta el momento no han sido aclarados.
Respecto a las violaciones de los derechos humanos que se producen y se han producido en Picón de Jarama, destacamos:
- Agresiones físicas y psicológicas. En Picón de Jarama se han producido agresiones que han requerido tratamiento ambulatorio por parte tanto de vigilantes como de educadores. Algunas de estas agresiones han sido denunciadas y la Comunidad de Madrid en lugar de favorecer la investigación ha puesto obstáculos a ésta. Los insultos y las agresiones psicológicas son constantes.
- Aislamiento como forma de castigo y medio “terapéutico”. El aislamiento, definido por la HCFA (Administración sanitaria estadounidense) como “encierro involuntario de una persona en una habitación o espacio del cual se le impide físicamente salir” se aplica por periodos que pueden ir desde unas horas a varios días. A esto hay que sumar la existencia, desvelada por el defensor del pueblo, de cubículos especiales de castigo donde se aísla a los menores por periodos de hasta varias horas. Las Naciones Unidas prohibieron en 1990 el uso de aislamiento como castigo a menores, puesto que es una forma de tortura que genera riesgo de suicidio, autolesiones y trastornos mentales a corto, medio y largo plazo.
- Violación del derecho a la intimidad. Desnudos integrales, exploraciones físicas del ano o la vagina, escucha de llamadas, lectura de diarios y cartas, retirada de fotos u otros objetos personales son prácticas vejatorias efectuadas constantemente en el centro Picón de Jarama.
- Medicación forzosa, indiscriminada y suministrada por personal no sanitario. A menudo los fármacos son dispensados por educadores que no están capacitados legalmente para ello. Tenemos constancia de varios casos en que los menores han sido sedados a la fuerza o bajo coacciones.
- Castigos humillantes. Los menores internos en Picón están sometidos a las “medidas educativas creativas” que escojan sus “educadores”, medidas que pueden consistir en todo tipo de humillaciones.
Tanto la Comunidad de Madrid, como la Fiscalía de Menores y el Defensor del Menor tienen constancia de estos hechos, no sólo a través del reciente informe del Defensor del Pueblo, sino mediante multitud de cartas, denuncias y quejas que han recibido, de los cuales presentamos públicamente varias hoy. Somos conscientes de que tras la Fundación O´Belén se encuentran poderosos intereses económicos y políticos, y lamentamos constatar que estos han sido más fuertes que el respeto a los adolescentes y trabajadores que han pedido ayuda. Por ello optamos por la vía directa: mientras continúe la impunidad seguirá habiendo movilización social contra el maltrato.
