Francisco Maya denuncia las torturas en la cárcel de A Lama

Con este comunicado pretendemos denunciar a nivel público, un nuevo caso
de tortura y vejación en las cárceles del Estado, llamado español, bajo el
amparo de su sistema judicial.
El día 5 de Enero de 2007, en el Centro Penitenciario de A Lama
(Pontevedra), el compañero Francisco Maya Fernández, encontrándose en el
módulo de aislamiento, fue víctima de un cacheo forzoso con desnudo
integral que derivó en una paliza a cargo de varios carceleros, la cual le
dejo en estado de inconsciencia bajo la lluvia en el patio de la prisión,
desnudo y esposado. Las consecuencias de la paliza, fueron en las semanas
siguientes diversos hematomas, dificultades cardiorrespiratorias e
hinchazón, a parte del trastorno depresivo que le causó este incidente,
que a pesar de no ser el primer cacheo ni la primera paliza que recibe el
compañero, se caracterizó por la morbosa crueldad por parte de los
carceleros.
Frente a estos hechos, Francisco interpuso una denuncia exigiendo el pago
de una indemnización por delitos contra el honor, y por la ilegalidad de
los actos perpetrados por esta banda de carceleros. En esta denuncia, el
compañero reiteró en más de una ocasión la ilegalidad que supone realizar
cacheos integrales a los presos y presas en el Estado. Además, el
compañero fue amonestado mediante un expediente disciplinario con la
calificación de “muy grave” por los hechos ocurridos.
A finales de Agosto, llegó la contestación al recurso interpuesto por
Francisco, por parte del Director del Centro Penitenciario de A Lama, en
la que, no sólo se niega la existencia de un registro con desnudo
integral, sino que se justifica la utilización de la fuerza desmesurada y
el abuso de autoridad por parte de los carceleros en base a una protesta
impulsada por los presos a principios de Enero, la cual condujo al
incendio de diferentes colchones en las mismas celdas de los presos. Esta
acción se produjo como consecuencia de la reiterada negativa de la
Institución Penitenciaria a suministrar a dos compañeros de galería la
medicación analgésica que necesitaban para su tratamiento, en un acto más
de abuso de los que comúnmente se producen sobre los presos en este
Centro. A continuación, reproducimos las palabras textuales del comunicado
emitido por el Director de dicho Centro:
En resumen:
NO SE PRODUCE el pretendido por el interno “cacheo con desnudo integral”,
sino un cacheo con palpación previo a su salida a hospital
extrapenitenciario.
NO EXISTE CONSTANCIA DE DECLARACIÓN DE “ILEGALIDAD” por el Juzgado de
Vigilancia Penitenciaria en relación a las actuaciones regimentales
adoptadas a raíz del incidente protagonizado por el interno, como el
manifiesta en el primer párrafo de su escrito, ante bien, consta un auto
del mismo Juzgado DESESTIMANDO la queja del interno.
Cabe señalar que MAYA FERNANDEZ es casi un “quejoso compulsivo”, por la
multitud de quejas que presenta ante Vigilancia Penitenciaria,
desestimadas hasta la fecha.
En el informe emitido por el subdirector médico queda presente la
implicación de estos individuos supuestamente “profesionales” en los casos
de tortura y vejaciones, declarando que no hubo ningún tipo de lesión ni
incidencia, ya que, según él, sólo se empleó “la fuerza mínima para la
sujeción mecánica de los presos”.
El sistema judicial de este Estado ha venido a demostrar una vez más de
parte de qué lado está, ya que tanto la denuncia como el recurso
interpuestos por el compañero Francisco Maya, así como las múltiples
pruebas ocultadas por el subdirector médico, no han servido para nada,
quedando así otro caso de tortura totalmente impune. Parece ser también
que para los jueces de este Estado, tienen menos valor los “quejosos
compulsivos” que los “torturadores compulsivos”, ejerciendo estos segundos
día tras día libremente su violencia.
Por nuestra parte, continuaremos denunciando todos los casos que lleguen a
nuestro conocimiento, dejándoles claro a nuestrxs opresorxs que ni la
tortura ni el aislamiento más feroz podrán separarnos jamás de nuestrxs
compañeros y compañeras presxs.

Anónimo — Vie, 28/10/2011 - 17:38estuve preso desde febrero de 2007 a mayo de 2010, en el modulo 6 de a lama, trabaje en el taller de cuadros electricos, alli tuve un accidente laboral, y que de mal de la pierna izquierda, yni en la mutua ni en la enfermeria me hicieron puto caso, presente denuncia en el juzgado y como venganza me llevaron pal modulo 13, tenia que salir en tercer grado en octubre de 2008 y me sacaron en marzo de 2009, pasandose el autio del juez pr el forro de los cojones, en tercer grado me hicieron la vida imposible y ya en marzo de 2010 y a dos meses del final de la condena me mandaron de vuelta a la lama, perdiendo el puesto de tarbajo en la calle y perdiendo a mi familia, que ya paso de mi, en mayo sali en libertad y a donde iba sin nadie , sin casa....me arruinaron la vida los muy hijos de puta.....con dos cojones recupere a mi familia, pero tarde un año en ganarmela de nuevo....... en resumen de que vale la carcel?.... de nada, te aislan del mundo exterior y no te dejan vivir.......y te joden la vida.....eso es lo que hay , a ver si el nuevo gobierno cambia el codigo penal para que los delitos menores se cumplan directamente en tercer grado.....desde aqui un saludo y un apoyo a todos los presos de españa.....

Anónimo — Jue, 04/11/2010 - 16:32tenia a mi novio ingresado por disputa familiar con la madre y lo ingresaron dos meses...estando dentro le murio el padre y no lo dejaron salir al entierroo esa gente nos dijeron que no podia y no podia pero que se piensan que son ?son personas y mi novio aora esta mal pq no pudo ver a su padre por ultima vez por culpa de los de la lamaa.eso es injustooo.y aparte que hay droga deberian de controlar mucho mas.o no saben acer su trabajo???NO ME LO EXPLICOOO GRACIASS

Anónimo — Lun, 14/06/2010 - 02:20TENGO UN HIJO K ESTA PRESO EN EL MODULO #6 EN NAVALCARNERO, EL TUVO UNA PELEA, DONDE TIENE 62 FIRMAS DE ESPANOLES CON ESCRITO , K EL ESTABA TRANKILO CUANDO FUERON Y LO BUSCARON Y DE HAY UNO DE LOS PRESOS DIJO K EL , Y OTROS 8 COMPANEROS ESTABAN VENDIENDO DROGA, SIN EMBARGO LES HICIERON UN CACHEO, DONDE NO LES ENCONTRARON NADA, Y SIN EMBARGO LOS TIENEN EN AISLAMIENTO Y MI HIJO ESTA MUY ENFADADO X K ELLOS NO TIENEN PRUEBAS DE NADA Y SIN EMBARGO LOS TIENEN EN AISLAMIENTO, YA UNO DE ELLOS EMPEZARON HACER HUELGA DE HAMBLE Y SED, Y SI NO LES PARAN BOLAS, SE VAN A UNIR TODOS ESTA SEMANA, ES LA UNICA FORMA K PUEDEN FRENAR LAS INGUSTICIAS, SOLO X K ELLOS NO SON ESPANOLES, SI NO ESTRANJEROS, KISIERA SABER SI ALGUNA AUTORIDAD, K AYUDEN A FRENAR LO K PASA EN ESA PRISION.

Anónimo — Jue, 03/06/2010 - 01:05esos presos el mal k an echo lo estan pagando sin libertad como en una jaula igual k a un pajaro no ay derecho tratarlos con esa brutalidad porque a eyos los tenian k ber por sus familiares mas keridos esos funcionarios merecen una espulsion definitiva sin trabajo y muertos de asco para k vean lo k es un sufrimiento. con este comentario kiero acer escuchar a los mas grandes y k ponga medios para k no vuelva a ocurrir esas clases de palizas y de turturas porque estas en el siglo 21 eso se acia en los años 70 y 80 cundo esistian ¨el torete y el vaquilla´´ aunque tampoco era justo pork si acian algo lo pagaban con su libertad y eyos no tienen ningun derecho de pegar esas palizas pork bayan con una placa y vestidos de azul. un gran saludo para francisco maya fernandez un fuerte abrazo y un besazo de tu prima betty
