APARECE MUERTA UNA PERSONA PRESA EN LA CÁRCEL DE NANCLARES

La cárcel de Nanclares ha inaugurado el nuevo año con la aparición de una persona presa
muerta de 53 años, muerte que se produjo anteayer, día 19 de enero en la cárcel de Nanclares
una vez más en extrañas circunstancias sin esclarecer.
Según las informaciones extraoficiales de las que disponemos, la muerte de F.J.V., se produjo
en la enfermería del penal. Al parecer le faltaba tan solo algo más de un año para cumplir su
condena. Tras dirigirnos al penal para solicitar información oficial, se nos ha comunicado
telefónicamente que “El director está reunido y no les puede atender”, por lo que instamos a los
medios de comunicación, a las instancias políticas y judiciales, así como a las entidades que
trabajan en defensa de los derechos humanos a que se dirijan a la Dirección de la cárcel y a la
Dirección General de Prisiones para que informen sobre las circunstancias de esta nueva
muerte por motivos no naturales.
Este hecho luctuoso representa una nueva crónica de muertes anunciadas en las cárceles tal y
como hemos venido denunciado. No podemos olvidar que tenemos constancia de la existencia
de 28 personas muertas durante los dos últimos años en los centros penitenciarios ubicados en
la Comunidad Autónoma Vasca y Navarra o con residencia administrativa en la CAPV muertas
en otras prisiones del estado.
Pero lo que resulta más grave es la política de ocultamiento y retraso en la información pública
sobre esta muerte y la nula iniciativa de actuación por parte de las autoridades judiciales
competentes para esclarecer las circunstancias de estas muertes por causas no naturales, en su
gran mayoría de personas jóvenes que no lo olvidemos mantienen una relación de sujeción
especial con la administración del estado y, éste, tiene la obligación de garantizar entre otros, su
derecho a la vida. Esta situación es inaceptable, sobre todo cuando la mayoría de esas muertes
podrían evitarse, simplemente, con la aplicación estricta de la actual legalidad vigente.
Una vez más preguntamos a la Dirección General de Prisiones, al Ministerio de Interior y al
Gobierno cómo va a terminar con esta terrible situación. Le preguntaremos cuántas muertes
han ocurrido realmente, quiénes eran los muertos, cuales fueron las causas, qué medidas
preventivas se establecieron, por qué no se excarceló a personas en avanzado estado de
enfermedad, por qué las condiciones de vida en general y sanitarias en particular empeoran,
que está haciendo con respecto a el hacinamiento, cómo es posible que haya tantas personas
presas con enfermedades mentales graves y la gran mayorías de ellas sin diagnóstico ni
tratamiento, por qué no cumple su propia legalidad cuando esta lo es en beneficio de la persona
presa y se excede en su cumplimiento cuando lo es en su perjuicio... son demasiadas las
preguntas sin responder.
Para acabar con estas muertes reclamamos medidas concretas tales como:
Que el Ministerio Fiscal no se inhiba e investigue de oficio estas muertes la mayoría de ellas
en extrañas circunstancias, tal y como le corresponde, para el esclarecimiento de las
circunstancias y motivos las mismas, con le fin de depurar las responsabilidades políticas,
administrativas y penales que se desprendan de estos hechos.
La inmediata reforma de la legislación penal y penitenciaria que alarga innecesariamente las
condenas y restringe el acceso a permisos de salida, tercer grado y libertad condicional que
son las formas de cumplimiento más acordes con el objetivo final que la ley otorga a las
penas privativas de libertad y que contribuyen a disminuir la presión y mal trato psicológico
que sufren las personas presas.
La reducción del número de reos hasta la capacidad óptima de cada prisión para evitar la
actual masificación, que aunque no es el único, si es uno de los motivos que influye en estas
muertes, así como el cumplimiento de las condenas en la el centro más cercano al lugar
habitual de residencia.
La excarcelación de las personas presas gravemente enfermas, en especial aquellas en fase
terminal, así como las que padezcan enfermedades mentales que en muchos casos suponen
la inducción al suicidio. Estas personas necesitan unos cuidados y un seguimiento médico
incompatibles con la cárcel que en muchas ocasiones es genera problemas de desequilibrio y
enfermedad mental.
El final de los regímenes de incomunicación y aislamiento. Estos espacios de impunidad
para torturas y/o malos tratos, son a la vez son espacios de riesgo para la aparición y/o
agravamiento de determinadas enfermedades mentales, lo que significa que, de por sí, el
aislamiento es una tortura psicológica a erradicar.
